1. Scope & Acceptance

By accessing or using the umoja.fm website, radio stream, newsletter, social media channels or any other content or services provided by umoja.fm (collectively, the "Services"), you agree to these Terms of Use. If you do not agree, please discontinue use of the Services.

The Services are operated by umoja.fm ("umoja.fm", "we", "us").

2. Intellectual Property

All content made available through the Services — including but not limited to audio recordings, track metadata, artist information, editorial content, graphics, logos and newsletters — is the property of umoja.fm or its licensors and is protected by applicable copyright and intellectual property laws. No content may be reproduced, distributed or otherwise used without prior written consent of umoja.fm, except as expressly permitted by these Terms.

3. No Text and Data Mining / AI Training

All content published or distributed by umoja.fm through any channel may not be used for text and data mining, web scraping, automated data extraction, or the training, fine-tuning or evaluation of artificial intelligence systems, large language models (LLMs), machine learning models or similar technologies, whether commercial or non-commercial, without the prior express written consent of umoja.fm.

This prohibition applies regardless of whether such use would otherwise be permitted under any applicable exception or limitation to copyright law, including but not limited to the text and data mining exceptions under Article 4 of the EU Digital Single Market Directive (2019/790/EU). umoja.fm expressly reserves all rights pursuant to Article 4(3) of that Directive.

4. Permitted Use

You may access and use the Services for personal, non-commercial purposes only. You may not: (a) use the Services for any unlawful purpose; (b) reproduce, distribute or commercially exploit any content without prior written consent; (c) attempt to interfere with or disrupt the technical operation of the Services.

5. Disclaimer

The Services are provided "as is" without warranties of any kind. umoja.fm does not warrant uninterrupted or error-free operation of the Services and accepts no liability for temporary unavailability or technical issues.

6. Limitation of Liability

To the fullest extent permitted by applicable law, umoja.fm shall not be liable for any indirect, incidental or consequential damages arising from your use of or inability to use the Services.

7. Governing Law & Dispute Resolution

These Terms are governed by the laws of the place of business of umoja.fm, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be finally settled by arbitration under the UNCITRAL Arbitration Rules. The number of arbitrators shall be one. The language of the arbitration shall be English.

8. Changes

We may update these Terms at any time. The current version is always available at umoja.fm/terms. Continued use of the Services after an update constitutes acceptance of the revised Terms.
